I don't know the full ins and outs of how the case can play out, he needs to answer and be held accountable for what he did. I don't think he had any intentions of raping a child though. So i don't have a clue what charges he will face or should be faced with.

I don't know, it's a difficult one. A young lassie has been raped and he has to be held responsible for it. But he wouldn't have raped her if he had known her real age, and it wouldn't have been rape if she was the age he thought she was.

It's a pretty difficult one, I don't think he's intentionally raped a child.  I don't know the full story but if he's been spoken to by the police in the early hours of the morning uptown you've got to assume that she didn't look her age.  If a sober policeman who's job it is to pick up on shit like this doesn't, then i'm not too sure how you can expect some daft 19 year old to.  He's also asked her her age, in which she's lied about.  

He's not been set up here, he's been incredibly stupid as even if she was 16 it'd be fucking creepy anyway but not illegal.  But going by the story at face value i'm not sure it's fair to say he has intentionally set out to rape a 12 year old.  If she had been 15 i think it'd be a different case but the fact that she's so young you'd assume it's only going to end up one way for him.

The last paragraph is, from what's been reported, true - I'd agree. I'm just always sceptical of these "but what if she didn't look her age" arguments. I've been teaching a pretty long time now and 12 years old is P7/S1. You can say someone looks older than their age at that point, but they'd still look like kids nonetheless.

Yes it's rape, as in the eyes of the law the girl isn't capable of consent. We all know that. We can't just pretend that she's incapable of conveying consent to the guy. She was in a taxi rank in the middle of the morning. She met a guy and chose to go back to his flat with him. She then chose to have sex with him. It's a shocking state of affairs but unfortunately there's plenty 12 year olds out there shagging other 12 year olds. It just so happens this 12 year old went up the town at the weekend and picked herself a 21 year old.

I'd be more concerned about the the living conditions of the lassie, what's going on at home, why is she sexualised at that age, why is she out at night and staying at a strangers house. There's a lot more questions to ask than whether or not the boy is a nonce.

Polis seem to be taking the Celtic FC line of "it's a minority and we should concentrate on the ones that don't engage in this behaviour and praise them".

Never rocks, but I remember one summer when we used to stand on top of a hill and pelt passing cars with water bombs as they went past. Fucking dangerous and stupid looking back, rocks are another level though.
