IJ - my initial thoughts too, on 'How can they'. Not unless the original upload can be traced to her, and indeed it names the university, nor was there likely a witness, or indeed a complainant. If they have a case, then I can only imagine that the rest of the video has her sitting up on the desk, playing with her Oregon State pen.

I thinks it's to do with being in a public place rather than witnessed by a member of the public. Like if the police found out about me going for a wank in the woods I could get done for public indecency even if nobody spotted me (they wouldn't)

Public space vs. private space isn't a very difficult concept to grasp.  Clearly if there hadn't been a video then with no witnesses charges couldn't have been made as no-one would've ever found out in the first place, but the presence of video evidence changes matters.

I think if you did a shite in the middle of a library you'd probably face charges, btw.

1) committing a criminal offence, and;
2) there's a "significant sexual element" to said offence.

Sitting in your living room with your baws out isnt a crime. Sitting in front of your open window leering at passers by and rubbing one out would be.
